DO I HAVE A MORTGAGE WITH IRPH?

The Mortgage Loan Reference Index (IRPH) is an index of mortgage loan interest rates similar to Euribor but prepared by the Bank of Spain on the average of the interests applied by savings banks and banks.

The mortgages that were referenced with this index generally have very high interest rates.

WHY CAN I COMPLAIN?

Although the Supreme Court endorsed the application of the IRPH in mortgages in 2020, pointing out that its application was not abusive despite failing to comply with the transparency requirements, on July 13, 2023 the Court of Justice of the European Union (CJEU) has issued a ruling in which consumer protection is strengthened by establishing that those consumers may claim affected by the lack of information on the possible application of a negative differential in the Mortgage Loan Reference Index (IRPH) to match it with other market indices such as the Euribor.

The amount varies depending on each mortgage, but the average amount of money recovered is around 15,000 euros.
